It is very true that the recent incident at Delhi was one of the brutal incidents against women. This kind of violent behavior is totally unacceptable.
First of all, I request that all the accused(including the minor if he too was involved in the rape) in the Delhi incident be awarded death penalty and the execution be preceded by worst possible torture.
Coming out of the Delhi incident for a while, the Indian government should have some strict laws towards rape in order to ensure that people with such minds will think 'N' number of times before actually committing such crimes. Singapore, Dubai and are examples of why the crime rate is very minimal. As this forceful act against women/men by a rapist can be on any one starting from a young kid to an extent of old women, it has to be understood thoroughly before imposing an law. At the same time, a single law should not be applied to all the categories rather there should be different categories with clauses within each.
Also note that always rape does not mean a forceful act by a men against women but, it can be the vice versa as well. The same law should apply even in such case.
Against adults:
According to me severity of the crime be considered as a factor to be looked upon while framing the new law. The severity of the crime can be like 'High', 'Medium', 'Low'.
'High' be awarded a 'torture + hang' immediately(But make sure we have found enough evidences against the accused. Because, sometimes innocent people get trapped.). e.g., of high severity would be the damini's case
'Medium' be hanged.
'Low' be given life imprisonment. In case the victim takes back the complaint and is ready to accept the accused(without any form of compulsion) even then charge a monetary penalty and use/donate it foe a good cause.
Against kids/minors:
Equivalent to 'High' for adults. This is unacceptable.
But while framing the law, there could be questions that would arise like:
What if the victim and accused are from the same family as compared to the accused being a stranger? And hence if it is latter based on family's will the case could be withdrawn with a crime penalty(government of india identifies as a crime) and use that money towards a good cause, but ensure to jail the accused for at least one month.
What if an old man is involved in such an act?

No. of times repeated: if it exceeds certain threshold say 10 treat it equivalent to 'Medium'
What if an minor is involved in such an act?

Feedback from students of opposite sex:
Give some weight-age to all such points(above) and based on that rate the severity. And do not hesitate to hang even if some one is minor if the weight is high/medium.
What if a mentally ill person is involved is such an act?
Check the history of the person(for how long he/she is ill) and in case it is found that it was the mistake of the care taker punish him/her with the same level of punishment.
